END USER LICENSE AGREEMENT

THIS AGREEMENT IS A LEGALLY BINDING CONTRACT; PLEASE READ IT CAREFULLY.

Thank you for playing our games! VerseUs Games B.V. (“VerseUs Games”, “we”, “us”, or “our”) is proud to provide you with our video game software (together with any updates, the “Game Client”) for use with its online components (a “Game Server”). Together, the Game Client and Game Server make up our video game experience (the “Game”). This End User License Agreement (the “EULA” or “Agreement”) governs your use of the Game Client. By installing, accessing, or using the Game Client, you agree to be bound by the terms of this Agreement.

By accepting this EULA, you represent that you are at least 16 years old. If you are under the age of 16, you may only use the Game with the consent or supervision of a parent or legal guardian who agrees to be bound by this EULA on your behalf.

1. Limited License

The Game Client is licensed, not sold. Subject to your compliance with this EULA, VerseUs Games grants you a limited, revocable, non-exclusive, non-transferable, personal license to:

(a) Download, install, and use the Game Client on your personal devices (“System”).

(b) Access and use the Game solely for your non-commercial, personal entertainment.

You agree that violation of any of the following license limitations will constitute a breach of this Agreement and infringement of VerseUs Games’ intellectual property rights:

You may not sell, rent, lease, license, distribute, or otherwise transfer the Game Client or any copies or modifications of the Game.

You may not create, distribute, or host any software or server designed to interact with or emulate the Game Client.

You may not modify, reverse engineer, decompile, or disassemble the Game Client.

You may not develop or use unauthorized software that interacts with the Game Client, such as cheats, hacks, bots, or other tools that provide an unfair advantage.

You may not exploit the Game for any commercial purposes.

All rights, titles, and interests in and to the Game, including the Game Client, are owned by VerseUs Games or its licensors. This license does not confer ownership of the Game or any intellectual property rights therein.

2. Termination

This EULA is effective until terminated. You may terminate this EULA at any time by permanently deleting all copies of the Game and associated materials from your System. VerseUs Games may terminate this EULA if you fail to comply with its terms, including any future revisions. Upon termination, you must cease all use of the Game Client.

3. Ownership

VerseUs Games retains all rights, title, and interest in and to the Game, including any content, code, and materials provided as part of the Game. All intellectual property rights in the Game are protected by copyright, trademark, and other applicable laws.

4. Consent to Monitor

You acknowledge and agree that VerseUs Games, its affiliates, or contractors may monitor your use of the Game Client and your System to ensure compliance with this EULA and to detect violations of the limited license terms. Monitoring is conducted solely for the purpose of enforcing this Agreement and ensuring the integrity of the Game.

5. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME CLIENT AND SERVER ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. VERSEUS GAMES DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. VERSEUS GAMES DOES NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

6. LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no event shall VerseUs Games, its affiliates, licensors, or contractors be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of data, or business interruption, arising out of or in connection with this EULA, regardless of the legal theory and even if VerseUs Games has been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless VerseUs Games, its affiliates, licensors, and contractors from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your breach of this EULA, your use of the Game in violation of applicable laws, or your violation of the rights of any third party.

8. Patches and Updates

VerseUs Games may deploy patches, updates, and modifications to the Game at any time to improve or modify the Game. Such updates may be automatically applied without your consent, and you agree to receive and allow such updates.

9. Seizure Warning

A small percentage of people may experience seizures or other conditions when exposed to certain visual stimuli, including flashing lights. If you have a history of such conditions, consult a physician before using the Game. If you experience symptoms such as dizziness or disorientation while playing, discontinue use immediately and seek medical advice.

10. Dispute Resolution and Governing Law

This EULA and any disputes arising from or related to it are governed by the laws of your country of residence. Any legal action shall be brought in the courts of that jurisdiction, unless otherwise agreed by both parties.

11. Severability

If any provision of this EULA is found to be unlawful or unenforceable, the remaining provisions will remain in full force and effect.

12. Miscellaneous

This EULA, along with any referenced documents, represents the entire agreement between you and VerseUs Games regarding the Game Client. Any waiver or modification of this EULA must be in writing and signed by both parties. You may not assign this Agreement without VerseUs Games’ consent.
